About these terms

Beycome runs www.beycome.com (the "Website"). It lets homeowners list homes on the Website and, if they choose, on the local multiple listing service ("MLS"). It also helps buyers and renters find, buy or lease those homes. Together, this is the "Service."

"Beycome," "we," "us" and "our" mean Beycome Corp., Beycome Brokerage Realty LLC, Beycome of Florida LLC and Beycome Brokerage Realty Inc. Beycome Corp. owns the Website. The other three are the licensed real estate brokers for deals made through it.

These terms ("Terms") are a binding agreement between you and Beycome. "You" means anyone who visits or uses the Website or Service. You and Beycome are each a "Party." By using the Service, you also agree to:

• Our Privacy Policy, which is part of these Terms.
• Our Exclusive Buyer/Renter Brokerage Agreement ("Buyer Agreement"), if it applies to you.
• Our Listing Agreement, Disclosures & Disclaimers ("Listing Agreement"), if you list your home on the MLS with us.

We may change these Terms, or change, pause, limit or end any part of the Service, at any time and without notice.

Users under 18

The Service is only for people 18 or older. By using it, you promise you are at least 18. We do not knowingly collect data from anyone under 18. If we learn a user is under 18, we close the account right away and delete their data. If you think a minor has an account, email contact@beycome.com. Parents and guardians must make sure their children do not use the Service.

Key words

Buyer:

a person who uses the Service to find and buy a Property.

Content:

everything on the Website except Personal Information, like text, data, designs, graphics, images, audio and video.

Documentation:

guides we give users online through the Website.

Intellectual Property Rights:

all legally recognized forms of intellectual property and the rights in them.

Owner:

a person who uses the Service to list a Property for sale or rent.

Payment Service:

any payment service run by our outside payment processors.

Personal Information:

any information that does or can identify a specific person.

Process:

to do anything with data, material, works or other Content.

Property:

any home listed for sale or rent through the Service.

Renter:

a person who uses the Service to find and rent a Property.

Technological Safeguard:

any code or feature we use to watch for, detect or block unauthorized access or use.

User:

anyone who visits the Website, including Buyers, Owners and Renters.

User Data:

any data, including Personal Information, that a User uploads or enters in the Service.

Using Beycome

• Your license: if you follow these Terms and pay what you owe on time, we give you a personal, worldwide, non-exclusive right to use the Service, the Website and its Documentation. You cannot transfer or sublicense this right, and we can take it back.
• Follow the law: you must follow all laws and rules that apply to your use of the Service and to any deal you make through it.
• Networks: the Website, your Content and your User Data may travel over many networks.
• Other users' data: you may not use other Users' data you get through the Service for anything illegal.
• Outside the U.S.: you must follow your local rules on online conduct, Content and User Data.

Emails, calls and texts

By using the Service, you agree to get emails and texts about listing, buying or renting a home. They may come from the Service, from Beycome or from another User.

By giving us your mobile number, you also agree to get recurring automated texts (SMS and MMS) from Beycome Corp. and its affiliates. These include property alerts, appointment reminders, deal updates and offers.

• How often: it depends on your activity and settings, up to 10 texts a month.
• Stop: reply STOP to any text. You get one last confirmation and no more texts unless you sign up again.
• Help: reply HELP, email contact@beycome.com or call 804-656-5007.
• Cost: message and data rates may apply. We are not responsible for carrier charges.
• Carriers: works with AT&T, T-Mobile, Verizon, Sprint, Boost Mobile, U.S. Cellular and most major U.S. carriers. Coverage may vary. Carriers are not liable for late or lost texts.
• Not required: you do not have to agree to texts to buy from Beycome. Opting out does not affect your access to our services.

We may also send marketing, like offers and newsletters, to your phone and email. We do not sell, rent or share your Personal Information with others for their own marketing. To opt out:

• Email: click "Unsubscribe" in any marketing email or write to unsubscribe@beycome.com.
• Text: reply STOP.

You may still get messages you need for your account or an active deal. See our Privacy Policy for details.

Your account

• One person, one account: some features need an account and password ("Account"). Your Account is personal. You may not share it or transfer it.
• Keep it safe: keep your password and user ID secret. Tell us right away if you think someone else knows your password.
• Phone privacy: to protect you from scams, we give you a free forwarding number to use instead of your personal number.
• Closing accounts: we may end your password, Account or access at any time, for any reason, including not using it or not paying fees on time.

Your listings and photos

• License to us: when you add Content to the Service ("Owner Content"), you give us a non-exclusive, worldwide, permanent, irrevocable and royalty-free license to use, copy, adapt, change, share, translate, publish, build on, perform, display and otherwise use it.
• Your promise: you have all the rights needed to give us this license.
• Check your listing: make sure your Content shows on the Website the way you want. Photos must show the actual Property. Do not include people without their legal consent.
• Honest listings: when you submit a listing, you promise that (i) you own the home or may act for the owner, and (ii) the listing is complete, accurate and true.

Our content

• Trademarks: Beycome names, logos and service marks are our registered and unregistered trademarks. You may not use them to put down Beycome or anyone else.
• Savings claims: any savings we mention are based on examples, algorithm estimates and predictions. Talk to your lawyer about what you might actually save.
• Copyright: all Content belongs to Beycome or its Owners and is protected by U.S. and international copyright laws. Unless we allow it, you may not change, rent, lease, lend, sell, share or build on it.
• Website content: everything on the Website is protected by copyright, trademark, trade secret and other laws. Unless we allow it, you may not sell, license, rent, change, share, copy, send, show, perform, publish, adapt, edit or build on it.

Our services

• MLS listing: we can list your home on an MLS, which tells member brokers and agents that it is for sale or rent.
• Mortgage calculator: it only shows rough monthly payments based on the numbers you enter.
• Outside providers: we may link buyers to lawyers, title companies, surveyors, lenders, trades, movers and others. We are not responsible for the quality of their work.
• Sample legal forms: these are for reference only. They are not legal advice.
• Photo packages: Owners can buy professional photos: 24 high-definition images of the home as-is, taken by local photographers.

Broker Compensation is fully negotiable and is not fixed, controlled, recommended, or suggested by law or any multiple listing service or association of REALTORS®.

Buyer program fees

As your buyer agent, Beycome asks the seller's agent to pay us a commission. If the seller has no agent, we ask the seller.

1% of the price minimum $1,499, paid at closing

You pay nothing when you sign. At closing, we keep 1% of the price, or $1,499 if that is more, from the commission the seller offers. The rest goes to you as a credit toward closing costs or as cash.

What happens at closing

• Commission more than our fee: you get the extra as a closing credit or cash.
• Commission equal to our fee: the seller covers our fee. You get no extra credit.
• Commission less than our fee: you pay the difference at closing.

Example with a 3% seller commission

Credits need lender approval. This offer does not apply to homes listed with no commission.

Rules since the NAR settlement (August 17, 2024)

• Written agreement first: we must sign a written agreement on our pay and duties before we show you any home.
• No commission on the MLS: listings no longer show the buyer agent's commission. After you sign, we ask the seller or their agent.
• Seller help is still allowed: you can still accept seller concessions, like help with closing costs.

Good to know

• Credits follow all rules, including HUD rules. They go toward closing costs, prepaids and other allowed costs. The final amount needs lender approval and may change with your loan amount and terms.
• Beycome pays for your first 5 showings. Each extra showing costs $44, added at closing.

Seller flat fees

Under a signed Listing Agreement, Owners pay a one-time flat fee ("Flat Fee") to list on the MLS, based on the prices on our Website:

You pay up front when you sign the Listing Agreement.

Payments and refunds

• Your card: you allow our payment processors to store and charge your card as these Terms describe. You are responsible for keeping your card details correct.
• Changes: we or our processors may change, limit or add payment features at any time, without notice.
• Extra terms: some payment features may need you to accept more terms.
• Processor fees: some processors may charge you extra fees. We are not responsible for them.
• Legal use only: you may only use payment features as allowed by U.S. law, the laws where you live and any other laws that apply.

Refunds

You get a full refund if you cancel before your listing goes live on the MLS. For the Enhanced package, you must also cancel before promo items ship and at least 48 hours before a booked photo shoot.

No refund is given when:

• The listing questionnaire is left incomplete for 30 days. The listing is treated as abandoned.
• The listing is off the market for more than 30 days in total, in a row or not. The listing is treated as abandoned.
• The listing breaks MLS rules. The Broker may then cancel it.

What you may not do

Unless these Terms allow it, you may not do, try to do, or knowingly let or help anyone else do any of the following:

1. Download, copy, publish or send any part of the Website.
2. Change, tamper with, adapt, translate, improve or build on the Website or Documentation.
3. Rent, lease, lend, sell, sublicense, assign, share, publish or transfer the Website or Documentation to anyone.
4. Reverse engineer, take apart, decompile, decode or decrypt the Website.
5. Get around, break or disable any security feature or Technological Safeguard.
6. Remove or change any trademark, copyright notice, Documentation or version number.
7. Use the Website in a way that breaks these Terms or our Intellectual Property Rights.
8. Process User Data or Personal Information beyond what these Terms allow.
9. Build, share or help build any software, website or service that works much like, or competes with, the Website.

Website support and security

• We do not have to provide or support the hardware, internet, software or bandwidth you need to use the Website.
• We may, but do not have to, use Technological Safeguards to watch use of the Website, stop misuse and protect our rights.
• We use reasonable care to keep the Website secure. Still, using it carries risks, like security breaches, downtime and lost or damaged data.
• We may change, pause or end the Website, for a time or for good, at any time and for any reason.

Disclaimers and limits

Promises we both make

Each Party promises the other that (a) it is a legal entity in good standing; (b) it is authorized to agree to these Terms; and (c) the person accepting for it has the authority and legal capacity to do so.

No warranties

Limits on our liability

Indemnification

"Indemnify" means you cover our costs if someone makes a claim because of you. You agree to indemnify, defend and hold harmless Beycome Corp., its affiliates (Beycome Brokerage Realty LLC, Beycome of Florida LLC, Beycome Brokerage Realty Inc., Beycome Title of Florida LLC and Beycome Mortgage LLC) and their officers, directors, agents, partners and employees (the "Indemnified Parties"). This covers all claims, demands, suits, investigations, damages, losses, liabilities, costs and expenses, including reasonable lawyer fees, that come from:

• Your use of, access to or inability to use the Service or Website.
• Your Content or User Data, including anything wrong, misleading or that breaks someone's Intellectual Property Rights.
• Any dispute or deal between you and another User, including buyer and seller disputes about a home sale made through the Service.
• Your breaking any law or rule, including RESPA, the TCPA, Fair Housing laws, MLS rules or state real estate license rules.
• Your unauthorized use or sharing of MLS or IDX data from the Service.
• Your breaking these Terms, the Buyer Agreement or the Listing Agreement.
• Any careless or wrongful act or failure to act by you in using the Service.

Notice and defense: we will tell you promptly about any such claim. If we are late, you still owe this protection, unless the delay seriously harmed you. We may take full control of the defense and settlement at our own cost. You must fully cooperate and may not settle without our written OK.

Our protection for you: Beycome will indemnify and hold you harmless from outside claims caused directly by Beycome's gross negligence or willful misconduct in providing the Service. This is subject to the liability limits above.

Copyright and DMCA

Claims against us: if someone claims the Website, Service or Documentation breaks their Intellectual Property Rights, we may, at our choice, use reasonable efforts to fix it or end your use of the Service.

Report a copyright problem: if you believe in good faith that Content on the Service breaks your copyright, you or your agent may ask us to remove or block it. Wire fraud warning

How to protect yourself:

• Always call your title company, closing lawyer or escrow officer to confirm wiring instructions. Find their number yourself, not in an email.
• Be wary of last-minute changes to wiring instructions or account numbers.
• Never click links in emails that claim to have new payment instructions.
• Confirm the money arrived with the receiving bank before closing.

Beycome Corp. and its affiliates are not liable for any losses from wire fraud, business email compromise or fake payment instructions, even if the message seems to come from Beycome. Got a suspicious message? Email contact@beycome.com right away and report it to the FBI at ic3.gov.

Electronic signatures

By using the Service and clicking "I agree," you agree to do business with us electronically under the federal E-SIGN Act and state e-signature laws. This means:

• Electronic signatures, records and notices count the same as paper ones and can be enforced.
• Clicking to accept these Terms is your prior express written consent and electronic signature.
• We may send notices, agreements and records electronically, like by email or in your account.
• You can ask for paper copies at contact@beycome.com. A reasonable fee may apply.
• You can take back this consent at any time. Past electronic deals stay valid.

You need a working device, internet access and a valid email. We are not responsible if problems on your end stop you from getting our messages.

Privacy, cookies and data

All data you give us or we collect is covered by our Privacy Policy, which is part of these Terms.

Cookies

We use cookies, web beacons, pixels and similar tools to run the Service, personalize it, study use and show targeted ads. By using the Service, you agree to this. We use four kinds:

• Essential: needed for the Service to work, like login and security. Turning them off breaks core features.
• Analytics: show us how people use the Website, like Google Analytics. Data is grouped and made anonymous where possible.
• Marketing: show you relevant ads and measure our campaigns. We or our ad partners may set them.
• Preference: remember your settings, like language and saved searches.

You can manage or block cookies in your browser. Some features may stop working. California residents have more rights under the CCPA. See our Privacy Policy.

California privacy rights

Once a year, for free, California residents can ask for a list of any third parties we shared their personal information with for direct marketing in the prior year. Under the CCPA (in effect since January 1, 2020), they can also make a verified request to see the personal information we collected about them, and in some cases ask us to delete it.

Data breaches

If a breach involves your Personal Information, we follow all federal and state notice laws, including Florida's FIPA and California's CCPA.

• When: without unreasonable delay and within the time the law requires, often 30 to 72 hours from discovery, by email or a clear notice on the Website.
• What we tell you: what happened, which data was involved, what we did and steps you should take.
• Your part: keep your login safe and tell us right away at contact@beycome.com if you suspect someone got into your account.
• Limit: our liability for a breach is subject to the liability limits above.

Accessibility

We work to make the Website and Service usable by everyone, including people with disabilities, under the ADA and WCAG 2.1 Level AA. If you have trouble, email contact@beycome.com or call 804-656-5007. We will make reasonable efforts to give you the information in a format you can use. We review the site often and fix issues we find. We are not responsible for the accessibility of outside services shown on the Website. Read our full Accessibility Statement.

Affiliated businesses (RESPA)

Section 8(c)(4) of the Real Estate Settlement Procedures Act (RESPA) requires us to tell you that Beycome has business ties with affiliated companies that may provide settlement services for your deal:

• Beycome Mortgage LLC: home loans and mortgages
• Beycome Title of Florida LLC: title insurance and closing
• Beycome Brokerage Realty LLC, Beycome Brokerage Realty Inc. and Beycome of Florida LLC: licensed real estate brokerage

Because of these ties, sending you to an affiliate may give Beycome Corp. a financial or other benefit. You do not have to use any Beycome affiliate to complete your deal. You are free to shop for and choose any settlement service provider.

Ask us and we will give you an estimated charge or range of charges for each affiliate. This notice does not guarantee any rate or fee.

Listing data

Listings on beycome.com may come from MLS feeds through IDX (Internet Data Exchange). This data is only for your personal, non-commercial use, to find homes you may want to buy.

• All listing information is deemed reliable but is not guaranteed to be accurate. Check it yourself.
• We update listings often, but they may not show a home's latest status. We make no promises about whether a listing is available, accurate or complete.
• Square footage, lot size, room counts and condition are estimates. Have an inspector or appraiser confirm them before you sign anything.
• IDX data is licensed from the MLS. Using, copying or sharing it without permission is strictly prohibited.

Beycome is not liable for any reliance on listing or property data shown on the Website.

Disputes and other terms

Please read this part carefully. It may greatly affect your legal rights.

• Arbitration: any dispute that comes, directly or indirectly, from these Terms or your use of the Service will be settled by final, binding arbitration run in English by JAMS, in Miami-Dade County, Florida.
• No class actions: you agree to settle any dispute with Beycome one-on-one, not as part of a class, combined or representative case.
• No jury trial: you and Beycome each give up, as far as the law allows, any right to a jury trial.
• Time limit: you must file any claim about the Service or these Terms within 2 years after it arose, or lose it forever.
• Lawyer fees: in any arbitration or court case, the winning side gets its reasonable lawyer fees and costs paid.
• Court orders: Beycome may ask a court for an order (injunction) to stop any breach of these Terms.
• Florida law: these Terms are governed by the laws of the State of Florida.
• Ending your access: if you break these Terms, we may suspend or disable your Account or end these Terms at our choice, without notice.
• Notices: we may send you notices by email or mail to the address in our records.
• Feedback: send feedback to contact@beycome.com. All submissions and Content you send become Beycome's property, with no payment to you.
• Fair housing: Beycome is committed to an inclusive marketplace built on trust, safety and respect, regardless of race, color, religion, national origin, ancestry, disability, sex, gender identity, sexual orientation or marital status.
• Whole agreement: these Terms are the entire agreement between you and Beycome about the Service. They replace any earlier agreements, proposals or talks on this subject.
• No waiver: if we do not enforce a right or rule right away, we do not give it up.
• How long these Terms last: they start when you first use the Service and last until your access is canceled or ended.
• Events beyond our control: Beycome is not liable for delays or failures caused by things outside its reasonable control, like natural disasters, pandemics, war, terrorism, strikes, government action or internet outages. Our duties pause while the event lasts.
